A judicial review has been launched into Prolog’s proposals to expand in Sudbury – putting the possible creation of 500 jobs at risk.
An application for a review into the plans for the £50 million development in Church Field Road has been submitted to the High Court.
Babergh District Council, which approved the planning application, has 21 days to reply before a judge will decide whether a legal challenge should go ahead.
Lord Hart, of Chilton Hall, said those opposing the project had felt compelled to seek a judicial review in order to protect the Grade I listed St Mary’s Church, their Grade II listed home and the surrounding area.
“We feel very strongly about this and think the development would cause serious harm,” said Lord Hart.
“These heritage assets are the last bits of Chilton that remain, historically, and are very important. They are being sacrificed.”
Prolog, a marketing and logistics company which already employs around 440 people in Milner Road, has been attempting to build on the 26,385 square metre site for more than 10 years.
It appeared work could finally begin after councillors approved plans on the promise that it would create up to 500 new jobs.
Agreement on a series of conditions, which had divided the council and the firm, was reached earlier this year.
Lord Hart, a former planning solicitor, said the council was wrong to approve the conditions, which will allow Prolog up to seven years to finish the development, after which it would only need to occupy the site for 18 months.
“The planning agreements are not worth the paper they are written on,” he said. “Babergh admits substantial harm will be caused and are relying on the jobs.
“Not a single promise is guaranteed and it is an illusion that 500 jobs will be created.”
